What Is DWLR in NC?
Driving while license revoked (DWLR) under G.S. 20-28 is a Class 1 or Class 3 misdemeanor in North Carolina depending on the circumstances. If your license was revoked for a DWI-related offense, the charge is elevated to a Class 1 misdemeanor. For other revocations, it is typically a Class 3 misdemeanor. Either way, DWLR is a criminal charge - not a simple traffic infraction. For help with related traffic matters, view all practice areas.
A DWLR conviction could carry additional license revocation on top of whatever revocation already existed, DMV points, SDIP insurance surcharges, and a permanent criminal record. Perhaps most significantly, a DWLR conviction while a revocation is pending makes license restoration considerably more difficult and can reset the clock on the revocation period.
Common Reasons for License Revocation in NC
- Accumulation of DMV license points (12 points within 3 years)
- Failure to pay a traffic fine or court costs
- Failure to appear in court (FTA)
- DWI or alcohol-related conviction
- Failure to maintain required auto insurance
- Child support non-payment
In some cases, drivers are unaware their license has been revoked until they are pulled over. If this describes your situation, the circumstances surrounding the revocation may be relevant to your defense.
How Clark Law Defends DWLR Cases
DWLR defense strategy depends heavily on the underlying reason for the revocation and the client's broader driving history. Common approaches include negotiating a reduction to a lesser charge, challenging the validity or proper notice of the underlying revocation, and working to resolve the underlying cause of revocation in parallel with the criminal charge.
Clark Law evaluates each DWLR case individually. Where the revocation stems from an administrative issue like unpaid fines or a missed court date, resolving that underlying issue can meaningfully impact the outcome of the DWLR charge itself. We work to address both the charge and the path to license restoration simultaneously where possible. Related defense topics include speeding ticket defense and reckless driving defense.
